1. Definitions of words and phrases used in the following Terms and Conditions

• ‘Agreed Hours’ – Massage therapist/s will be available for the hours as agreed between the Client and Pummel&Knead

• ‘Client’ – The client who has requested the on site massage treatment from Pummel&Knead

• ‘Individual’ – The individual guest/employee of the Client receiving a treatment from Pummel&Knead

• ‘Treatment’ – The treatment requested by the Client and confirmed by Pummel&Knead and performed as described on our website.

• ‘Massage Therapist’ – The individual therapist who attends the premises for the purpose of performing the treatment

• ‘Premises’ – The location address as confirmed to Pummel&Knead by the Client

• ‘The Services’ – The services set out in Clause 2 of this agreement

2. The Services

​

i. Pummel&Knead shall provide qualified and insured Massage Therapists to the Client at the Premises for the Agreed Hours. All therapists are covered for Professional Liability Insurance.  Copies of the therapist’s certificates will be sent to the Client on request.

ii. Pummel&Knead shall provide Treatments as requested by the Client and attend to the requirements of each Individual who requires a Treatment exercising proper professional skill and diligence in the rendering of the Treatment

iii. The Massage Therapist reserves the right not to provide a Treatment for any Individual they deem unfit to receive such Treatment.

 

3. The Client’s Obligations

i. The Client must provide a suitable contact person for Pummel&Knead to liaise with

ii. All Individuals receiving a Treatment must sign a medical consultation form prior to their first treatment and inform the Massage Therapist prior to any subsequent treatment of any changes to the information given on the medical consent form.

iii. The Client is responsible for delivering the Treatment schedule to the Massage Therapist before the start of the Agreed hours if applicable. Pummel&Knead can supply template schedules on request.

iv. The Client will explain to each Individual the nature and extent of the Treatment.

4. Payment by the Client

​

i. The Client is responsible for payment to Pummel&Knead of the agreed hours that has been booked as one of our packages via the website. .

ii. An additional fee towards travelling costs may be apply if premises of the Client are outside Greater London. This is to be agreed between the Client and Pummel&Knead.

iii. There is no VAT applicable to these cost

iv. Payments are made by direct bank transfer through an invoice policy. Payment must be received within 14 days of receipt of invoice.

5. Cancellations and changes

​

i. Once a booking has been placed, cancellations will incur the following charges:

a. Cancellations made with up to 5 working days notice will not be charged and a full refund will be given

b. Cancellations made with less than 5 working days notice given will incur a 50% charge and a 50% refund.

c. Cancellations made with less than 3 working days notice given will incur the full fee and no refund.  

ii. Any changes to the Agreed Hours must be flagged up to Pummel&Knead up to 48 hours before the booking. The ability to accommodate any changes is at the discretion of Pummel&Knead and can not be guaranteed.

iii. Pummel&Knead reserve the right to cancel the provision of the Services without notice in the case of illness of a Massage Therapist or other circumstances beyond its control. In this circumstance the client will be offered an alternative day or a full refund will be issued.

 

6. Termination

​

This Agreement will terminate automatically if either party shall be in breach of any of its obligations under this Agreement or if either party shall have a receiver, administrative receiver, or administrator appointed, or shall enter compulsory or voluntary liquidation.

 

7. Liability & Insurance

​

The Client acknowledges that the Massage Therapist is an independent contractor and not an employee of Pummel&Knead and that any liability as to the provision of a Treatment is between an Individual and the Massage Therapist.

8. Disclosure and Security of Personal Data

​

i. In accordance with GDPR, information and personal data from the disclaimer/medical consultation form,  provided by the individual before receiving a treatment, shall only be shared between the Massage therapists of Pummel&Knead to enable effective and ongoing treatment. Data is never disclosed to any third parties or used for any marketing or promotional purposes unless consent is given. 

ii. Appropriate security measures are in set in place to protect unauthorised access and store the individuals data confidentially. 

iii. Personal data must be kept for 7 years for insurance purposes. 

iv. Individuals may request access to their own personal data at any time. 

 

9. Law

​

This Agreement is subject to English Law and the sole jurisdiction of the English Courts.
